General Terms and Conditions (GTC) for the online shop of Renee Fuchs

1. Scope

1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts concluded by consumers with Renee Fuchs, Brüsseler Straße 48, 50674 Cologne (hereinafter referred to as “Seller” or “we”) via the online shop at www.finimi.de .

1.2 Consumers within the meaning of these Terms and Conditions are natural persons who conclude the transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

1.3 Deviating terms and conditions of the customer will not be recognized unless we expressly agree to their validity in writing.

2. Conclusion of contract

2.1 The presentation of the goods in our online shop does not constitute a legally binding offer, but a non-binding invitation to order (invitatio ad offerendum).

2.2 By clicking the "Buy" button, the customer places a binding order for the goods contained in the shopping cart. Confirmation of receipt of the order will be sent immediately after the order is submitted and does not constitute acceptance of the contract.

2.3 The contract is only concluded upon our express declaration of acceptance or upon delivery of the goods.

3. Prices and payment terms

3.1 All prices quoted are final prices and include the statutory VAT of 7%.

3.2 The shipping costs will be clearly communicated to the customer before placing the order.

3.3 Payment can be made via PayPal or Klarna. Further information on payment methods is available on our website.

4. Delivery conditions

4.1 The delivery conditions, delivery date and any existing delivery restrictions can be found in a correspondingly designated area on our website or in the respective item description.

4.2 If the customer is a consumer, the seller shall bear the shipping risk in any case, regardless of the shipping method.

5. Right of withdrawal

5.1 Consumers have a statutory right of withdrawal. We provide information about this right of withdrawal in the cancellation policy, which is provided to the customer during the ordering process.

5.2 The cancellation policy and the cancellation form are available on our website under the “Cancellation” section.

6. Retention of title

6.1 The delivered goods remain our property until full payment has been made.

7. Warranty

7.1 The statutory warranty regulations apply.

8. Liability

8.1 We are liable without limitation for damages resulting from injury to life, body or health that are based on a negligent or intentional breach of duty by us or our legal representatives or vicarious agents.

8.2 We shall only be liable for other damages if these are based on gross negligence or intentional breach of duty.

8.3 In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), our liability is limited to the foreseeable, contract-typical damage.

8.4 There is no further liability.

9. Packaging licensing

9.1 We are obliged to properly license our packaging in accordance with the provisions of the Packaging Act.

9.2 Our registration number in the LUCID packaging register is: DE6003755498600.

10. Applicable law and place of jurisdiction

10.1 The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the state in which the customer has his or her habitual residence remain unaffected.

10.2 For customers with residence or habitual abode in Austria or Switzerland, the mandatory consumer protection provisions of their country also apply.

10.3 If the customer is a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law or has no general place of jurisdiction in Germany, our place of business shall be the place of jurisdiction for all disputes arising from this contract.

11. Final provisions

11.1 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
